We are very grateful for being awarded Managing IP's Europe Impact Case of the Year Award for our work in the UPC proceedings against Revolt Zycling on behalf of our client myStromer. We thank our Swiss colleagues at IPrime Legal, Rudolf A. Rentsch and Raphael Zingg, for entrusting us with breaking new ground in front of the UPC right after the new court opened its doors. This case brought together what the UPC is all about – two Swiss companies, an international trade fair and the Düsseldorf local division that understood the urgency. It issued the first UPC preliminary injunction ex parte within just one day after filing. Completing this “series of firsts”, the court later on also ordered the first ever penalty payment in front of the UPC. When preparing the original PI request, the core team around lead counsel Klaus Haft benefitted greatly from HOYNG ROKH MONEGIER’s truly European presence, receiving comments and invaluable support on a rolling basis from all the offices at HOYNG ROKH MONEGIER. This allowed the PI request to reflect the knowledge and experiences of all jurisdictions in which HOYNG ROKH MONEGIER already has a strong national presence. The case was a blueprint for all the firm’s UPC work that followed so far, inter alia on behalf of Fujifilm against Kodak, on behalf of Texas Instruments against Network System Technologies, on behalf of Verifone against Nokia, on behalf of Samsung against Headwater Research, on behalf of Lenovo against Ericsson, or on behalf of Hurom against NUC and Air Liquide against Hoffmann-La Roche.#wedoIP #intellectualproperty #UPC #unifiedpatentcourt#MIPAwards2024 #europeanimpactcaseoftheyear
