A Montana Highway Patrol trooper noticed the vehicle Birdtail was driving had a broken brake light and failed to use a signal while changing lanes, court documents note.
"After initiating emergency lights to conduct a traffic stop, the defendant slowed in the center lane of three lanes to approximately 30 miles per hour, nearly coming to a stop on the Interstate," the arresting trooper wrote in documents filed in Lewis and Clark County Justice Court.
The trooper noted Birdtail had five passengers, including the two infants and three adults. Birdtail admitted to smoking marijuana with the other adults just prior to the traffic stop, according to court documents.
